SMS Program Terms

CallsHQ Lead & Call Notifications

Program name: CallsHQ Lead & Call Notifications.

Program description: When a customer calls and CallsHQ handles the call on your behalf, the business owner receives an SMS summarizing the caller's name, phone number, request, and urgency. These messages are transactional and are sent only to the business owner and staff who have opted in.

Message frequency varies based on your call volume.

Message and data rates may apply.

Opt-out: Reply STOP to unsubscribe at any time. Reply HELP for help.

Support: [email protected].

Carriers are not liable for delayed or undelivered messages.

Consent is not a condition of purchase.

Appointment Notifications (Calls & Texts to Customers)

When you call a business served by CallsHQ and an appointment is scheduled, you agree to receive service messages from CallsHQ, on behalf of that business, about that appointment.

What these messages are for: Only to confirm, remind you about, or notify you of changes to your appointment. These are transactional service messages — not marketing, advertising, or promotional content. We will not send you promotions, offers, or any message unrelated to your appointment.

How we contact you: By SMS text message and by phone call, using the phone number you provided when the appointment was booked.

When we contact you: Text messages are sent only between 8:00 AM and 9:00 PM, and phone calls only between 8:00 AM and 7:00 PM, in your local time zone.

Message frequency: Varies based on your appointment activity (for example, a confirmation, a reminder, or a change notice).

Message and data rates may apply.

Opting out: Reply STOP to any text message to stop receiving texts. To stop calls, tell us during any call or contact the business. Consent to these messages is not a condition of any purchase.

Your phone number is used only to contact you about your appointment and is never sold or shared for marketing.

The service

CallsHQ is a 24/7 customer service line for small businesses. It answers your business calls, captures lead details, and sends you a summary of each call by text and email. Features and availability may change over time.

Eligibility & accounts

You must be at least 18 years old and authorized to act for your business. You are responsible for the information you provide, for keeping your account credentials secure, and for all activity under your account.

Billing & free trial

CallsHQ is offered on a recurring subscription at the price shown at signup, billed in advance each billing period. New accounts may include a free trial; unless you cancel before the trial ends, your paid subscription begins automatically. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

Fair use of call handling

Your plan includes call handling for normal small-business call volume, with no per-minute charges. If your usage is consistently and substantially higher than typical business use, we may contact you to move you to a plan that fits — we will always reach out first and will never apply surprise charges. We may limit, throttle, or suspend use that is abusive, unlawful, or automated/non-genuine.

Acceptable use

You agree to use CallsHQ only for lawful purposes and in compliance with all applicable laws, including call-recording and consent laws in the jurisdictions where you and your customers are located. You are responsible for ensuring you have any consents required to record or process calls handled through the service.

Customer call data

You are responsible for the customer call data captured through your account and for handling it in accordance with applicable law and your own privacy commitments to your customers. We process this data on your behalf to provide the service.

Data Retention

We retain your call data — including recordings, transcripts, caller details, and appointment information — for two (2) years from the date of each call. After two years, this data is automatically and permanently deleted.

If you wish to retain your data longer than two (2) years, you must request an extension in writing before the deletion date.

You may request an export of your data, an extension, or early deletion at any time by contacting legal@callshq.com.

You own your customer data. CallsHQ processes it on your behalf as your service provider (processor); you are the data controller. Upon account termination, we will provide an export of your data on request and delete our copy.

Service availability

We work to keep CallsHQ available and reliable, but we do not guarantee uninterrupted or error-free operation and provide no uptime guarantee. Service may be affected by factors outside our control, including carrier and third-party provider outages.

Disclaimers

CallsHQ is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, CallsHQ and CONECOMAI LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of or relating to the service is limited to the amount you paid us for the service in the three (3) months immediately before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless CallsHQ and CONECOMAI LLC from any claims, damages, losses, and expenses arising out of your use of the service, your customer call data, or your violation of these Terms or applicable law.

Termination

You may stop using the service and cancel at any time. We may suspend or terminate access if you violate these Terms or use the service unlawfully. Provisions that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the service will be the state and federal courts located in Wyoming.
